Phase
I of the Emergency Snow Ordinance
When
slippery or otherwise hazardous driving conditions are in existence,
including, but not limited to snow, sleet, or freezing rain, which
may lead to traffic congestion, the city manager or his designate
(Superintendent of Streets and Sewers) may declare a driving emergency.
Until such driving emergency is terminated, no person shall operate a motor vehicle on any such street or boulevard in such a manner or in such conditions as to allow, cause or permit such vehicle to become stalled because of the fact that driving wheels are not equipped with all-season tire, snow tires, or chains.
Failure to have all-season tires, snow tires, or chains installed on such vehicle shall be prima facie evidence of a violation of this subsection. When such driving emergency is deemed to exist, the city manager or his designate (Superintendent of Streets and Sewers) shall give notice thereof by announcing to the public through the news media and the police chief or his designate the date and time of it’s commencement.
The verbal notice shall therefore be confirmed by written order from the city manager to the judge of the municipal court, police chief, and city clerk. Notice of the date and time of the termination of driving emergency shall be issued in the same manner as the commencement thereof.
Phase
II of the Emergency Snow Ordinance
When
circumstances exist or are reasonably contemplated to exist in the
immediate foreseeable future, including, but not limited to actual
or anticipated snow removal operations, the city manager, or his designate
(Superintendent of Streets and Sewers) may declare a parking emergency.
Until such parking emergency is terminated, no vehicle shall be parked on any emergency route. Within two hours after the declaration by the city manager or his designate (Superintendent of Streets and Sewers) all vehicles shall be removed from the streets and boulevards designated. Notice of the declaration shall be given as set out in Phase 1.
At the discretion of the director of public works and transportation, a parking emergency upon any of the streets and boulevards designated in subsection c of this section may be terminated at such time as a parking emergency shall cease to exist upon certain streets and boulevards without regard to a parking emergency which may exist on other streets and boulevards.
Penalty
for Violation of Snow Ordinance
Owners or operators of vehicles in violation of this section shall be subject to a fine as set forth in Section 28-104 of the Code of Ordinances. Vehicles in violation of this section may be towed to the city tow lot or any other place so designated, in addition to the fine as set forth in this subsection, by the police chief and stored at the owner's expense. Such vehicles may be recovered by the owner upon payment of a towing and storage fee.
Emergency
Snow Routes No Parking
The
streets and boulevards listed in Section
28-1576 shall be emergency routes. The director of public works
and transportation shall post the appropriate signs designating such
streets and boulevards as emergency routes.
